Gift Registry Terms & Conditions

1. Introduction

These Gift Registry Terms & Conditions ("Registry Terms") govern the use of the gift registry feature provided by Sitenest Ltd ("we," "our," or "us"), operating as wedsite.ai. The gift registry feature allows couples to create wishlists of items that wedding guests can contribute money towards.

By using the gift registry feature, whether as a registry creator (couple) or a contributor (guest), you agree to be bound by these Registry Terms in addition to our general Terms of Service and Privacy Policy.

Part A: Terms for Registry Creators (Couples)

2. Stripe Connect Account

2.1 Account Requirement

To receive contributions through your gift registry, you must set up a Stripe Connect Express account. This is a requirement imposed by our payment processor to enable secure, regulated payment processing.

2.2 Verification Requirements

Stripe requires identity verification to comply with UK financial regulations. You will need to provide:

  • Full legal name and date of birth
  • Home address
  • Government-issued ID (passport or driving licence)
  • Bank account details for receiving payouts

This information is collected and stored directly by Stripe. We do not have access to your identity documents or full bank account details.

2.3 Stripe's Terms

By creating a Stripe Connect account, you also agree to Stripe's Connected Account Agreement and Stripe's Privacy Policy.

3. Platform Fees

3.1 Fee Structure

The following fees apply to registry contributions:

  • Platform fee: 3.5% of each contribution is retained by Wedsite to cover the costs of providing and maintaining the registry service
  • Payment processing fees: Standard Stripe processing fees (approximately 1.5% + 20p for UK cards) are deducted by Stripe

3.2 Fee Calculation Example

For a £100 contribution: approximately £96.5 goes to your Stripe account after our 3.5% platform fee, with Stripe's processing fees then deducted at payout. The exact amount received depends on Stripe's current fee structure.

4. Payouts

4.1 Payout Delay

Contributions are held for 30 days before they become available for payout to your bank account. This delay exists for:

  • Chargeback protection: To protect you from fraudulent contributions that may be disputed
  • Regulatory compliance: To comply with UK payment regulations and anti-money laundering requirements
  • Fraud prevention: To allow time for potentially fraudulent transactions to be identified

4.2 Payout Schedule

Once the 30-day holding period has passed, funds are typically paid out to your linked bank account within 2-3 business days. Payouts are processed by Stripe according to their payout schedule.

4.3 Stripe Dashboard

You can view your contribution balance, pending payouts, and payout history through the Stripe Express dashboard, accessible from your Wedsite account.

5. Your Responsibilities as Registry Creator

As a registry creator, you agree to:

  • Provide accurate information when setting up your Stripe Connect account
  • Create registry items that accurately represent genuine gift wishes
  • Not use the registry for fraudulent, illegal, or deceptive purposes
  • Acknowledge contributions appropriately (we provide contributor details so you can thank your guests)
  • Report any suspicious or unauthorised contributions to us immediately
  • Comply with all applicable tax obligations related to gifts received

6. Tax Considerations

Gifts received through your wedding registry are generally considered personal gifts and are not subject to income tax in the UK. However, you are responsible for understanding and complying with any applicable tax obligations. We recommend consulting with a tax advisor if you have questions about the tax treatment of contributions received.

We do not provide tax advice and are not responsible for any tax liabilities you may incur. Contribution records are available in your dashboard for your personal record-keeping.

Part B: Terms for Contributors (Guests)

7. Making Contributions

7.1 Contribution Process

When you contribute to a gift registry:

  • You can contribute any amount towards a registry item (see minimum amounts below)
  • Multiple guests can contribute to the same item until it is fully funded
  • You can include an optional message with your contribution
  • Your contribution is processed immediately upon successful payment

7.2 Payment Security

All payments are processed securely by Stripe. Your card details are never stored on our servers. Stripe is certified to PCI Service Provider Level 1, the highest level of security certification in the payments industry.

7.3 Confirmation

After a successful contribution, you will receive an email confirmation with details of your contribution. This email serves as your receipt for the transaction.

8. Refunds for Contributors

8.1 Refund Policy

Registry contributions are treated as gifts to the couple. As such, refunds are generally not available once a contribution has been successfully processed.

8.2 Exceptional Circumstances

Refunds may be considered in the following exceptional circumstances:

  • Duplicate or erroneous charges (technical errors)
  • Fraudulent use of your payment method
  • Wedding cancellation (at the couple's discretion)

8.3 Requesting a Refund

If you believe you are entitled to a refund, please contact the couple directly in the first instance. If the couple agrees to a refund, they can initiate it through their Stripe dashboard. For technical issues or fraud-related concerns, please contact us at [email protected].

8.4 Chargebacks

We encourage you to contact us before initiating a chargeback with your bank. Chargebacks for legitimate contributions may be disputed, and filing fraudulent chargebacks may result in legal action.

9. Contributor Data

9.1 Information Collected

When you make a contribution, we collect:

  • Your name (to identify your contribution to the couple)
  • Your email address (to send you a confirmation receipt)
  • Your optional message to the couple
  • Transaction details (amount, date, payment reference)

We do not store your payment card details. These are processed directly by Stripe.

9.2 How Your Data is Used

Your contribution data is used to:

  • Process your contribution
  • Send you a confirmation email
  • Notify the couple of your contribution so they can thank you
  • Maintain records for accounting and tax purposes

9.3 Data Retention

Your contact information is deleted 6 months after the wedding date. Transaction records are retained for 7 years as required by UK tax law. For more information, see our Privacy Policy.

Part C: General Terms

10. Our Role

Wedsite acts as a technology platform that facilitates the connection between couples and their guests for gift registry purposes. We are not a party to the gift transaction between you and the couple. We do not:

  • Guarantee that couples will use contributions for stated purposes
  • Hold contributions in trust or escrow (payments go directly to the couple's Stripe account)
  • Guarantee delivery of any physical items listed in the registry
  • Mediate disputes between couples and contributors beyond providing transaction records

11. Prohibited Uses

The gift registry feature must not be used for:

  • Fraudulent fundraising or crowdfunding
  • Money laundering or other financial crimes
  • Collecting payments for illegal goods or services
  • Any purpose that violates applicable laws or regulations

We reserve the right to suspend or terminate registry access and report suspicious activity to relevant authorities.

12. Limitation of Liability

To the maximum extent permitted by UK law, Sitenest Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the gift registry feature. Our total liability for any claims arising from registry services shall not exceed the platform fees collected from the relevant transactions.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by UK law.

13. Dispute Resolution

If you have a complaint about the registry service, please contact us at [email protected]. We will endeavour to resolve any disputes promptly and fairly.

For payment-related disputes, you may also contact Stripe directly through their support channels. These terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these Registry Terms from time to time. We will notify registry creators of material changes by email and/or through their dashboard. Continued use of the registry feature after changes take effect constitutes acceptance of the updated terms.
